By accessing or using rootednsoil.com (the "Site"), you agree to these Terms of Service. If you do not agree, please do not use the Site.
Who We Are
This Site is operated by Rooted In SoIL, LLC ("we," "us," or "our"), a limited liability company based in Southern Illinois.
What This Site Is
The Site is an informational website describing our software products. It does not provide the products themselves. Home Inspection Report Builder, InSync Notes, InclusivScan, and SoIL Software Solutions are each delivered through their own websites and governed by their own separate terms and license agreements. Nothing on this Site grants you a license to any of our software.
Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to the Site, its servers, or related systems
- Interfere with or disrupt the Site, including by introducing malicious code
- Use automated means to scrape or harvest content, or to submit the contact form
- Send unsolicited commercial messages through the contact form
Contact Form Submissions
Information you send through the contact form is handled as described in ourPrivacy Policy. Please do not send confidential or sensitive material through the form. A submission does not create a client relationship, and no obligation arises until we agree in writing on scope and terms.
Custom Software Engagements
Custom software is scoped individually, and any engagement is governed by a separate written agreement covering scope, deliverables, timeline, fees, and ownership. These Terms do not create such an agreement, and nothing on the Site is an offer or a commitment to perform work.
Intellectual Property
The Site and its contents — including text, graphics, logos, and our product names and marks — are owned by us and protected by intellectual property laws. You may view and share the Site's content for personal, non-commercial purposes. You may not reproduce, distribute, or create derivative works from it without our written permission.
Third-Party Links
The Site links to websites we do not control, including our product sites and external services. We are not responsible for the content, policies, or practices of those websites. Following a link is at your own risk.
Disclaimer of Warranties
The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that the information on it is complete or current.
Limitation of Liability
To the fullest extent permitted by law, Rooted In SoIL, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of your use of or inability to use the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).
Indemnification
You agree to indemnify and hold harmless Rooted In SoIL, LLC and its members from any claims, losses, or expenses, including reasonable attorneys' fees, arising out of your use of the Site or your violation of these Terms.
Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law rules. Any dispute arising from these Terms or the Site will be brought in the state or federal courts located in Illinois, and you consent to their jurisdiction.
Changes to These Terms
We may revise these Terms from time to time. Continued use of the Site after we post changes means you accept the revised Terms. The "last updated" date above shows when they last changed.
